Terms of Service

These Terms of Service govern your use of the Dayworthy website at dayworthytravel.com and the Dayworthy travel-planning application at app.dayworthytravel.com together (the Services). Dayworthy is operated from Chihuahua, Chihuahua, Mexico.
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Beta status and informational nature
Dayworthy is currently in free public beta. Features, availability, design, integrations, limits, pricing, and product plans may change as the Services evolve.
Dayworthy is a travel-planning and recommendation tool. It is not a travel agency, booking service, transportation provider, venue operator, insurer, medical provider, legal adviser, or public-safety authority.
Travel recommendations and assumption of risk
Destination, city, place, route, timing, and itinerary recommendations generated or displayed by Dayworthy are informational suggestions only. They are not professional travel, safety, health, medical, immigration, legal, or other professional advice, and they are not a guarantee of any outcome.
Dayworthy does not guarantee the accuracy, completeness, quality, availability, safety, legality, suitability, opening status, price, accessibility, or current conditions of any suggested place, route, activity, service, or itinerary.
Travel conditions change. You are solely responsible for the decisions you make before and during travel and for independently verifying information that may affect your trip, including visa and entry requirements, passports and other documentation, local laws, safety and security conditions, health requirements and advisories, weather, transportation conditions, opening hours and closures, reservations, accessibility, prices, and costs.
Travel involves inherent and sometimes unexpected risks. By choosing to travel or follow an itinerary, you knowingly assume the risks associated with your own travel decisions. You are responsible for deciding whether an itinerary, activity, destination, route, or place is appropriate for you and the people traveling with you.
To the fullest extent permitted by applicable law, Dayworthy and the persons involved in operating the Services are not liable for dissatisfaction, loss, injury, damage, cost, delay, missed reservations or transportation, closure, cancellation, unsafe condition, or other unexpected event arising from or related to reliance on a suggestion or itinerary, your travel decisions, or a third-party place, venue, provider, or service that Dayworthy does not control.
Nothing in this section excludes liability, rights, warranties, or remedies that applicable law does not permit to be excluded or limited.
Accounts
Some app features require an account. You are responsible for using a valid account that you are authorized to use and for maintaining the security of your sign-in method and devices.
You may not use another person’s account without permission, misrepresent your identity, attempt to bypass access controls or usage limits, or use the Services to gain unauthorized access to another person’s data.
Dayworthy may suspend or disable access where reasonably necessary to protect the Services, prevent abuse, investigate security concerns, comply with law, or enforce these Terms.
Your trips, content, and instructions
You retain your rights in trip information, notes, lists, prompts, feedback, and other content you submit to the Services.
You grant Dayworthy a limited right to host, process, reproduce, transform, transmit, and otherwise use that content only as reasonably necessary to operate, secure, maintain, support, and improve the functionality of the Services, including generating AI-assisted travel recommendations and itineraries.
You are responsible for the content you submit and for ensuring you have the right to provide it. Do not submit unlawful content, malicious code, passwords, payment credentials, passport numbers, highly sensitive health information, or other information that is not needed for the feature you are using.
If you deliberately enable public sharing for an itinerary, you understand that anyone with the resulting sharing link may be able to view the information exposed through that shared itinerary until sharing is disabled or the trip/account is deleted.
AI-generated content
Some recommendations, itineraries, explanations, and other outputs are generated or assisted by artificial intelligence. AI-generated output may be inaccurate, incomplete, outdated, repetitive, unsuitable, or inconsistent even when it appears confident or specific.
You must use your own judgment and verify critical travel information independently. Dayworthy may change AI providers, models, prompts, routing, or product logic as the Services evolve.
Acceptable use
You may use the Services for lawful personal travel-planning purposes and other uses expressly made available by Dayworthy.
You may not:
- interfere with or disrupt the operation, security, or integrity of the Services;
- attempt to gain unauthorized access to accounts, systems, data, or administrative functions;
- introduce malware, harmful code, automated abuse, or other malicious activity;
- use bots, scraping, bulk extraction, or automated systems in a way that materially burdens the Services or copies protected content at scale without permission;
- circumvent rate limits, quotas, access controls, or other safeguards;
- use the Services for unlawful, fraudulent, abusive, or rights-infringing activity; or
- use Dayworthy’s output as a substitute for professional advice where professional judgment is required.
Third-party services, places, and links
The Services may display or link to information about third-party destinations, venues, accommodations, transportation providers, restaurants, attractions, websites, maps, or other services.
Dayworthy does not control those third parties and is not responsible for their acts, omissions, availability, safety, quality, policies, prices, transactions, or content. A reference, ranking, recommendation, map result, or link does not by itself create an endorsement, partnership, agency relationship, or guarantee.
If you choose to interact or transact with a third party, that relationship is between you and the third party and may be subject to separate terms, policies, and conditions.
Payments and future paid features
Dayworthy is currently offered as a free public beta and does not currently process payments through the Services.
If paid features are introduced, the price, material purchase terms, and applicable payment or cancellation conditions will be presented before you complete a purchase. Additional terms may apply to paid features where legally required.
Intellectual property
The Dayworthy name, logos, visual identity, software, original content, interfaces, design, and other protected elements of the Services are owned by or used with permission by the operator of Dayworthy and are protected by applicable intellectual-property laws.
Except as permitted by law or expressly authorized, you may not copy, reproduce, distribute, sell, license, reverse engineer, or create derivative works from protected portions of the Services.
Third-party names, trademarks, images, place information, maps, and other materials remain the property of their respective owners where applicable.
Privacy
Our Privacy Policy explains how personal information is handled across the Services, including account data, trip and preference information, AI processing, location-aware features, public sharing, retention, deletion, and service providers.
Availability and changes to the Services
We may modify, add, remove, suspend, limit, or discontinue features or portions of the Services. During beta, features may be experimental or change without notice.
We do not guarantee that the Services, a particular feature, an AI model, a third-party integration, or stored content will always be available without interruption.
No warranties
To the extent permitted by applicable law, the Services and their content are provided on an “as is” and “as available” basis. We disclaim warranties to the extent the law permits, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.
We do not guarantee that the Services will be uninterrupted, error-free, secure, complete, current, or suitable for any particular trip or traveler.
Nothing in these Terms excludes warranties, consumer rights, or remedies that applicable law does not allow to be excluded.
Limitation of liability
To the fullest extent permitted by applicable law, Dayworthy and the persons involved in operating the Services will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, loss of opportunity, loss of data, travel disruption, or costs arising from or related to your use of, inability to use, or reliance on the Services.
This limitation includes, to the extent legally permitted, claims arising from AI-generated recommendations, travel decisions, itinerary changes, third-party venues or providers, service interruptions, inaccurate information, or content submitted by users.
Where liability cannot lawfully be excluded or limited, these Terms do not attempt to exclude or limit it beyond what applicable law permits.
Governing law and jurisdiction
These Terms and your use of the Services are governed by the applicable laws of Mexico, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection right or jurisdiction that cannot lawfully be waived, disputes arising from or relating to these Terms or the Services will be submitted to the competent courts located in Chihuahua, Chihuahua, Mexico.
Nothing in this section deprives you of mandatory consumer protections or other rights that applicable law does not allow you to waive or contract around.
Changes to these Terms
We may update these Terms as Dayworthy, the Services, or applicable requirements evolve. The current version will be posted on this page with its effective date.
Where appropriate, we may provide additional notice of material changes. Your continued use of the Services after updated Terms become effective means the updated Terms apply to future use, to the extent permitted by applicable law.
